LAST WILL & TESTAMENT
A Last Will and Testament is a written instrument executed by which a person makes disposition of his/her estate to take effect after death. It outlines how a person’s assets should be distributed and specifies other important matters. Having a will in place allows the testator to designate Guardians for their minor children.
REVOCABLE/IRREVOCABLE TRUST
A Revocable Trust outlines the assets you want to give a beneficiary and how the assets will be distributed. The owner of a revocable trust may change its terms at any time. They can remove beneficiaries, designate new ones, and modify stipulations on how assets within the trust are managed. The trustee determines how the assets are invested and distributes them when the trust owner dies. However, the trustee must manage the trust following the guidelines laid out when the trust was formed, including giving funds to the designated beneficiary or beneficiaries.

An Irrevocable Trust details your assets and how you would like them to distributed to your beneficiaries. Unlike a Revocable Trust, an Irrevocable Trusts are set in stone. Some exceptions allow changes if all the beneficiaries agree to them, but the proposed updates must go through an approval process, which can include going before a judge.

The persons listed on the HCPA document become the sick or injured person's agent. It is best to list alternates in case the first-named HCPA is not available to serve in this capacity.
DURABLE POWER OF ATTORNEY
Durable powers of attorney help you plan for medical emergencies and declines in mental functioning. If you become incapacitated through illness, accident, or mental decline as you age, a general durable POA allows the agent you have selected to step in and handle your finances right away. If you don't have a general durable power of attorney, your family may have to go to court and have you declared incompetent before they can take care of your finances for you. Having these documents in place helps eliminate confusion and uncertainty when family members have to step in to handle finances or make tough medical decisions.
